Judges (Justices of the Peace or Magistrates) can issue protective orders based on allegations of domestic abuse in a family violence situation. This protective order or restraining order is in effect for a specified period of time. This is even if the alleged victim recants or changes his or her story. This can create heavy burdens because often temporary restraining orders prevent access to a family's house, including access to collect clothing or other necessities.
As a domestic violence attorney, I work to get restraining orders and emergency protective orders modified or lifted. Modification of a restraining order could allow the individual accused of domestic violence or spousal abuse back into the home, or it could allow for domestic violence counseling as an alternative to a domestic violence prosecution.
